Welcome to Bubuu. These Terms of Use (“Terms”) are a binding agreement between you and BUBUU Inc., a Delaware corporation (“Bubuu,” “we,” “us,” or “our”), and they govern your use of Bubuu wherever you access it, on bubuu.ai or built into another website (together, the “Service”). These Terms apply to users in the United States, the EU, or elsewhere. Please read them together with our Privacy Policy and Cookie Policy, which are part of these Terms.

By accessing or using the Service, clicking to accept, submitting a listing or property information, submitting a text call or video, requesting a report, or otherwise interacting with Bubuu or the Service in any way, you agree to these Terms. If you do not agree, do

not use the Service.

1. What Bubuu Is

Bubuu is an AI chatbot for real estate. You can ask it questions in plain language, paste a link to a property listing, or describe a property, and Bubuu uses AI to give you information and analysis to help you understand it, such as neighborhood overviews, pricing context, mortgage and affordability scenarios, and other property research tools.

When you ask us to, Bubuu can also connect you with one or more real-estate agents who can help you with your request, and can offer optional features such as an AI-supported call or follow-up. Connecting you with an agent always requires a separate request or consent from you (see Section 13).

Bubuu is an information and connection tool. Its answers are general information, not professional advice, and Bubuu does not act as your real-estate agent or broker and does not represent you in any transaction unless you and Bubuu enter into a separate written brokerage or representation agreement. Bubuu is not a lender, mortgage broker, appraiser, insurer, tax adviser, or law firm. Bubuu or an affiliate may hold a real-estate broker license; how that affects these Terms is explained in Section 7.

2. Acceptance and Changes to These Terms

We may modify these Terms at any time. If we make changes, we will update the “Last updated” date and, where the change is material, provide additional notice as required by law. Changes are effective when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

3. Eligibility and Permitted Users

You may use the Service only if you are an individual at least 18 years old, are using the Service for your own personal, non-commercial purposes, and are legally able to enter into these Terms.

The public Service is not for use by real-estate brokers, agents, teams, platforms, data providers, lead buyers, advertisers, or other commercial users. Broker, agent, and partner relationships are governed by separate written agreements, not by these Terms. By using the Service, you represent that you meet these requirements.

4. Using Bubuu

You use Bubuu by chatting with it. You can ask a question, paste a public real-estate listing link, or type details about a property, and Bubuu may fetch and analyze that information, ask follow-up questions, and respond with information, analysis, and tools — and, where helpful, an AI-supported property report. To unlock certain features or be connected with an agent, you may be asked for your name, email address, and phone number and to accept these Terms and our notices.

You can also upload files. In addition to chatting, pasting links, and typing details, you may upload materials such as photos, documents, floor plans, and PDFs, and Bubuu may support additional formats, including video, over time. Files and other materials you upload are part of “Your Content” and are subject to Section 9, including your representations that you have all rights necessary to provide them. Reports and saved sessions are accessed through a browser link, and we do not promise PDF downloads, email delivery, account storage, or any particular format.

5. Bubuu on Partner and Third-Party Websites

Bubuu may be made available to you as an overlay, widget, plug-in, or embedded experience on websites operated by publishers, media owners, or other partners (each, a “Partner Site”). When you use Bubuu on a Partner Site:

Your use of Bubuu is governed by these Terms and the Bubuu Privacy Policy, regardless of the site on which Bubuu appears.
The Partner Site is operated by a third party and is governed by that third party’s own terms and privacy practices, for which Bubuu is not responsible.
The presence of Bubuu on a Partner Site does not mean Bubuu endorses, verifies, or is affiliated with the Partner Site or its content, and the Partner Site’s display of its content does not mean it endorses Bubuu.
Bubuu may receive or share information in connection with a Partner Site placement as described in, and consistent with, the Bubuu Privacy Policy and your choices.

You are responsible for complying with any applicable terms of the Partner Site, applicable law, and for ensuring you are permitted to use Bubuu in connection with the content you submit.

6. AI Outputs Are Informational Only

Bubuu uses artificial intelligence. AI and machine learning are evolving, and AI outputs can be limited, incomplete, inaccurate, outdated, biased, or unsuitable for your circumstances. Any Bubuu chat response, call summary, estimate, scenario, score, comparison, or report (collectively, “Output”) is AI-supported, indicative, and provided for general information only.

Because of the nature of AI, Output may not be unique, and other users may receive similar or identical Output. You must evaluate Output for accuracy and appropriateness for your use case, including using independent verification and human review as appropriate, before relying on or sharing it.

You must not rely on Output as the sole basis for, and Bubuu is not responsible for decisions you make regarding, any real-estate, financial, or related matter, including without limitation: an offer, asking, purchase, sale, or rental price; a decision to buy, sell, rent, finance, insure, or invest; a loan, mortgage, or financing decision; renovation, construction, or repair costs, scope, or feasibility; eligibility for, the terms of, or the costs or savings associated with any government program, grant, subsidy, incentive, rebate, or tax benefit; a tax filing or planning decision; an insurance decision; legal due diligence; or a formal appraisal or valuation. Before making any real-estate or related decision, you should independently verify facts with official sources, inspect the property, and consult qualified licensed professionals.

7. No Professional Advice; No Agency; Real-Estate Licensing

General information, not advice. Bubuu's answers, analyses, and reports are general information and research tools. They are not legal, tax, financial, mortgage, lending, insurance, investment, appraisal, or engineering advice, and they are not licensed real-estate brokerage advice or a recommendation to take any specific action. Output is not a formal appraisal or valuation and must not be presented as one.

No agency or representation. Using Bubuu does not create any fiduciary, agency, brokerage, or professional-client relationship between you and Bubuu. Bubuu does not act as your agent or broker and does not represent you, a seller, or any other party in a transaction unless you and Bubuu enter into a separate written brokerage or representation agreement that expressly says so. Connecting you with an agent under Section 13 does not create an agency relationship.

Real-estate licensing. Bubuu, or an affiliate, may hold one or more real-estate broker licenses either in the United States or in Austria. Where Bubuu holds such a license, and to the extent any part of the Service is determined to constitute licensed real-estate activity, that activity is provided under Bubuu's applicable license, and is subject to applicable real-estate law and to any separate written agreement.

8. Fair Housing and Nondiscrimination

Bubuu supports compliance with the federal Fair Housing Act and applicable state and local fair-housing laws. You must not use the Service, Output, or any broker introduction to engage in or facilitate unlawful discrimination, steering, or any conduct that violates fair-housing or equal-opportunity laws. Output is not intended to express any preference, limitation, or discrimination based on any protected characteristic, and you must not use it for any such purpose. You expressly hold Bubuu harmless for any and all liabilities associated with a broker’s actions or inactions on or off the platform and understand a third-party broker is not affiliated with Bubuu.

9. Your Content; Licenses and Representations

“Your Content” means the listing URLs, property information, chat messages, and files and other materials you upload (such as photos, documents, floor plans, PDFs, and, where supported, video), and any other inputs you submit to the Service (“Input”). As between you and Bubuu, you retain ownership of your Input, and you are solely responsible for it, including its accuracy, legality, and your right to provide it.

Your representations and warranties. You represent and warrant that: (a) you own, or have obtained, all rights, licenses, consents, and permissions necessary to submit Your Content and to grant the licenses in this Section; (b) you are authorized to submit any listing URL, listing information, photos, or other third-party information you provide, and to permit Bubuu to access, analyze, and use it as described in these Terms; and (c) Your Content, and Bubuu's permitted use of it, does not and will not infringe, misappropriate, or violate any third party's copyright, trademark, privacy, publicity, contractual, or other rights, or any applicable law. You are solely responsible for Your Content, and you assume all risk associated with it and its submission.

No obligation to pre-screen. Bubuu does not pre-screen or monitor Content and is not responsible for it, but Bubuu may, at its sole discretion and without obligation or liability, review, refuse, remove, restrict, edit for format, or disable access to any Content or listing information, including where Bubuu believes it infringes a third party's rights, violates these Terms, or is unlawful.

To the extent permitted by law, and as between you and Bubuu, you own the report and other Output generated for you, for your personal, non-commercial use; Bubuu assigns to you its right, title, and interest, if any, in that Output, subject to the licenses and reservations in these Terms and to Bubuu’s rights in the Service and its underlying technology. This assignment does not extend to other users’ Output or to any third-party materials.

Licenses you grant. You grant Bubuu a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable (to Bubuu’s affiliates, service providers, and partners) and transferable license to host, store, copy, process, analyze, display, transmit, create derivative works of, and otherwise use Your Content and Output to: operate, provide, secure, and improve the Service; perform broker matching where you request or consent to it; comply with law; and enforce these Terms. Bubuu may also create, use, retain, share, and disclose de-identified, anonymized, or aggregated data derived from Your Content, Output, and your interactions, including with Bubuu’s affiliates, service providers, and research and academic partners, for analytics, benchmarking, the development and improvement of products, services, and AI models, and for research and the publication of research findings, provided such data does not identify you. As between you and Bubuu, Bubuu owns all such de-identified, anonymized, and aggregated data.

Feedback. If you provide suggestions, ideas, or other feedback about the Service, you grant Bubuu a perpetual, irrevocable, worldwide, royalty-free right to use it for any purpose without obligation or compensation to you.

10. Bubuu Intellectual Property

The Service, including all software, models, prompts, user interfaces, text, graphics, the Bubuu name and logos, and all related intellectual property, together with all usage data, aggregate data, and any improvements, derivative works, know-how, inventions, and developments arising from your use of or our provision of the Service, are and remain the exclusive property of Bubuu and its licensors. Except for the limited rights expressly granted to you in these Terms, Bubuu reserves all rights. No rights are granted by implication, estoppel, or otherwise. You may not remove or alter any proprietary notices. The Bubuu name and logos may not be used without our prior written permission.

11. Acceptable Use

You agree that you will not, and will not permit anyone to:

use the Service unlawfully or submit unlawful, infringing, defamatory, harmful, or misleading content;
submit fake leads, false contact details, or false or misleading property information;
submit paywalled, login-protected, confidential, or non-public listing data, or third-party content or personal data, that you are not authorized to provide;
scrape, crawl, harvest, bulk-access, or extract data or Output from the Service, or use automated means to access it, except as we expressly authorize in writing (see Section 12);
reverse engineer, decompile, probe, or attempt to discover non-public model logic, source code, or security systems, or extract or replicate the models;
use Output to develop or train a competing product or model;
represent that Output was human-generated when it was not;
interfere with or disrupt the Service or its security, or bypass or circumvent any access controls, rate limits, or usage limits (see Section 12);
use Output for unlawful discrimination or in violation of fair-housing laws;
resell, sublicense, or commercially exploit the public Service, or publish or present Output as a formal appraisal, valuation, or professional advice; or
use the public Service as a broker, agent, lead buyer, or commercial data user without a separate written agreement.

Reports are for your personal information. You may not publicly republish, market, or present them as official or professional documents without Bubuu’s prior written permission.

12. Authorized Access

Bubuu grants you a limited, revocable permission to access and use the Service only (a) through the interfaces and methods Bubuu makes available, (b) for your own personal, non-commercial use, and (c) as expressly permitted by these Terms. Any other access to the Service is unauthorized and exceeds the access you are granted.

Bubuu uses, and may use, technical measures to control, monitor, and restrict access, including authentication requirements, rate limits, access caps, bot-detection, CAPTCHAs, and similar controls. You must not bypass, disable, avoid, or circumvent any of these measures, and you must not access the Service through automated means, scripts, scrapers, crawlers, or headless tools, or extract or harvest data or Output, except as we expressly authorize in writing.

Bubuu may suspend, limit, or revoke your authorization to access all or part of the Service at any time and for any reason, including by written notice (such as a cease-and-desist) or by technical means (such as blocking an IP address, device, or account). You are not authorized to access the Service after your authorization has been suspended or revoked, and any such access is access “without authorization” and access that “exceeds authorized access” for purposes of the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and analogous state computer-crime laws.

13. Broker Matching and Matched Agents

Broker matching is optional and requires a separate request or consent from you; it is not bundled into general use of the Service or report unlock. Before you consent, Bubuu describes the recipient category as one or more matched real-estate agents; you may not see the exact agent before consenting. After your consent and matching, Bubuu may share information such as your name, email address, phone number, property link or address, the generated report, the AI chat and call transcripts, your buyer or seller intent, and budget or affordability information, as described in the consent and the Privacy Policy.

Matched agents are independent third parties. Their advice, conduct, services, agreements, valuations, offers, negotiations, fees, and transaction outcomes are solely between you and the agent, and Bubuu is not responsible for them. Once your information is shared with a matched agent, that agent generally acts as an independent controller of your information and may provide its own privacy notice. Bubuu does not guarantee any match, agent availability, contact, valuation, financing, or transaction outcome, and may re-match you with another agent. Matched agents may contact you as described in Section 15.

How Bubuu is compensated. The Service is free for you to use. Bubuu may receive compensation in connection with a referral or a resulting transaction — for example, a referral fee or a share of the real-estate commission paid by a cooperating broker or agent. This compensation does not increase any amount you pay, and it does not change the informational nature of Bubuu's answers, your freedom to choose any agent, or your ability to decline or end a match. Any commission share is an arrangement between Bubuu and the cooperating broker or agent and, where required, is made under Bubuu's real-estate license. Bubuu does not pay or accept fees for the referral of mortgage, title, or other real-estate settlement services except as permitted by applicable law.

14. AI Calls

You may be offered an AI-supported or generated call. The call will make clear that you are interacting with an AI system. AI calls collect, structure, and route property information and do not provide professional advice. Call audio may be temporarily processed or recorded by Bubuu or a service provider so it can be transcribed and routed, as described in the Privacy Policy. You may request human follow-up where available. You provide consent to be recorded pursuant to applicable law.

Service communications. Bubuu may contact you about a specific report, property, AI call, broker-matching request, or other workflow you requested, using the contact details you provide.

Marketing and promotional communications. If you provide your phone number and opt in, Bubuu (and providers acting on its behalf) may contact you by call or text message — including using automatic telephone dialing systems, prerecorded or artificial voice, and AI-generated voice — for marketing and promotional purposes. Your prior express written consent to such marketing is obtained at sign-up and is not a condition of using the Service or obtaining a report. Message frequency varies; message and data rates may apply. If applicable, you may opt out of marketing texts at any time by replying STOP and reply HELP for help, and you may opt out of marketing calls by telling us or contacting info@bubuu.ai. We honor opt-out requests promptly and maintain an internal do-not-call list. We may still send service and transactional messages tied to your requests.

Matched agents may contact you about the relevant property or request by phone, email, SMS, or other channels where permitted and based on your request or consent; an agent’s communications are governed by the agent’s own practices, and they are responsible for their own compliance with all laws, rules, and regulations. Bubuu makes no representations or warranties about their business practices or compliance with the law.

16. Privacy

Our Privacy Policy explains how we collect, use, and share personal information, and our Cookie Policy explains our use of cookies and similar technologies. Broker or agent privacy notices may also apply after a broker handoff. By using the Service, you acknowledge our Privacy Policy.

17. Third-Party Materials and Links

The Service may include or rely on listings, market data, public-register data, model outputs, and other content from third parties (“Third-Party Materials”) and may link to third-party websites. Bubuu does not control and is not responsible for Third-Party Materials or third-party websites, including their accuracy, availability, legality, or practices. Third-Party Materials are the property of their respective owners and may be protected by copyright and other laws; they are provided for general information, and you may not copy, redistribute, or use them except as permitted by their owners or applicable law. Your use of Third-Party Materials and third-party websites is at your own risk and subject to their terms.

18. Copyright Complaints (DMCA Notice and Takedown)

Bubuu respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. It is our policy to respond to clear notices of alleged copyright infringement and, in appropriate circumstances, to remove or disable access to material claimed to be infringing and to terminate access for users who are repeat infringers.

Notice of claimed infringement. If you believe that content available through the Service infringes a copyright you own or control, please send a written notice to our designated copyright agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate it (such as the URL); (d) your name, address, telephone number, and email address; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

Designated copyright agent: Josh Thaller, BUBUU Inc., a Delaware corporation, 540 Graham Avenue, Brooklyn NY 11222, email: copyright@bubuu.ai. Bubuu will register and maintain this agent with the U.S. Copyright Office. Notices that do not comply with the DMCA may not receive a response.

Counter-notification. If your material was removed or disabled and you believe this was the result of mistake or misidentification, you may submit a written counter-notification to the designated agent containing the information required by 17 U.S.C. § 512(g), including your signature, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, and your consent to jurisdiction as required by the DMCA. We may restore the material as permitted by law.

Repeat infringers. Bubuu will, in appropriate circumstances and at its discretion, restrict or terminate the access of users who are repeat infringers.

Misrepresentations. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake, may be liable for damages.

19. Availability, Changes, Suspension, and Termination

The public Service is currently provided free of charge unless separate terms or pricing are introduced. We do not promise uninterrupted access, any service level, a specific report format, or a specific broker match. We may update, improve, suspend, restrict, or discontinue all or part of the Service at any time for legal, security, operational, product, maintenance, abuse-prevention, or technical reasons.

We may restrict, suspend, or terminate your access to the Service, and refuse or remove reports, broker matching, or follow-up, at any time and without liability, where we reasonably believe it is necessary due to misuse, fake data, legal or security risk, abuse, third-party-rights concerns, or a breach of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 6–12 and 20–26) will survive.

20. Disclaimer of Warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, BUBUU DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR TRADE USAGE.

BUBUU DOES NOT WARRANT THAT THE SERVICE OR OUTPUT WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, SECURE, UNINTERRUPTED, OR ERROR-FREE, OR THAT ANY PROPERTY VALUE, PRICE, FINANCING, TAX, INSURANCE, BROKER MATCH, AGENT AVAILABILITY, OR TRANSACTION OUTCOME WILL BE ACHIEVED. ANY USE OF OUTPUT IS AT YOUR SOLE RISK, AND YOU WILL NOT RELY ON OUTPUT AS A SOLE SOURCE OF TRUTH. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

21. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUBUU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST OPPORTUNITIES, OR LOSSES ARISING FROM DECISIONS MADE IN RELIANCE ON OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, BUBUU’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BUBUU FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

22. Indemnification

To the fullest extent permitted by law, you will indemnify, defend, reimburse, and hold harmless Bubuu and its affiliates, officers, employees, agents, and licensors from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: your Content or submissions (including any claim that your Content infringes, misappropriates, or violates a third party’s intellectual-property or other rights); your use or misuse of the Service or Output; your violation of these Terms or applicable law (including fair-housing, privacy, intellectual-property, or anti-spam laws); or your interactions or dealings with any matched agent or third party.

23. Dispute Resolution; Binding Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE IN COURT AND TO HAVE A JURY TRIAL.

Informal resolution first. Before starting an arbitration, you agree to first contact us at info@bubuu.ai and provide a written description of the dispute and the relief sought, and to give us 60 days to resolve it informally. Many concerns can be resolved this way.

Agreement to arbitrate. You and Bubuu agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved exclusively by final and binding individual arbitration, rather than in court, except that either party may bring qualifying claims in small claims court and either party may seek injunctive relief for intellectual-property misuse. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Arbitration procedures. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitrator decides all issues, except that a court decides the enforceability of the class-action waiver below. The arbitrator may award the same individual relief a court could.

CLASS-ACTION AND JURY WAIVER. YOU AND BUBUU AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND BUBUU WAIVE ANY RIGHT TO A JURY TRIAL. IF THIS CLASS-ACTION WAIVER IS FOUND UNENFORCEABLE AS TO A PARTICULAR CLAIM, THAT CLAIM (AND ONLY THAT CLAIM) WILL PROCEED IN COURT.

Opt-out. You may opt out of this arbitration agreement by sending written notice to info@bubuu.ai within 30 days of first accepting these Terms, stating your name and intent to opt out. If you opt out, the governing law and venue in Section 24 apply to your disputes.

24. Governing Law and Venue

These Terms and any dispute not subject to arbitration are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and, where applicable, the Federal Arbitration Act. To the extent a dispute is not subject to arbitration, the state and federal courts located in New York County, New York will have exclusive jurisdiction, and you consent to personal jurisdiction there. Nothing in this section deprives a consumer of the protection of mandatory rules of the consumer’s home jurisdiction where those rules cannot be waived by agreement.

25. Notice for California Users
